1. Purpose
These terms and conditions govern seasonal rental bookings made on the website https://cap-neree.fr/.
They apply between the DEDALUS SCI, hereinafter “the Landlord”, and any person making a reservation request, hereinafter “the Tenant”.

2. Nature of the rental
The rental is granted as a temporary holiday residence. It cannot constitute a primary residence, a permanent secondary residence, or a standard residential lease.
The rental period cannot exceed 90 consecutive days for the same tenant.
3. Reservation
The Renter selects the desired dates on the website and submits a booking request with their contact details.
A booking request does not constitute automatic acceptance. The booking becomes firm only after written confirmation by email from the Landlord and payment of the required deposit.
The Landlord may refuse a request if the dates are no longer available, if the minimum conditions of stay are not met, or if the request is incomplete or clearly unsuitable for the capacity of the accommodation.
4. Price
The total price is shown before the booking request is confirmed. It may include:
- The price of overnight stays
- Cleaning fees
- The applicable tourist tax
- Any options expressly accepted by the Tenant
Prices are shown in euros.
5. Payment
Payment is made by bank transfer, Credit Card or Paypal.
Unless otherwise specified in writing:
- A deposit of 30% of the total amount is due within 48 hours of booking confirmation.
- The balance is due no later than 30 days before arrival.
- For any booking made less than 30 days before arrival, the full price is due upon confirmation.
The account is binding on both parties. In the event of non-payment within the specified period, the reservation may be cancelled and the dates made available again.
6. Security deposit / deposit
A security deposit of 300 € is requested before or upon arrival. It covers any potential damage, loss, deterioration, replacement costs, exceptional cleaning costs, or breaches of the Tenant’s obligations.
The security deposit will be returned no later than 7 business days following departure, provided there is no damage or justified deductions. In the event of a deduction, the Landlord will provide the available supporting documentation.
7. No right of withdrawal
In accordance with Article L221-28, 12° of the Consumer Code, the right of withdrawal does not apply to accommodation services, other than residential accommodation, which must be provided on a specific date or during a specific period.
The Renter therefore does not benefit from a statutory 14-day cooling-off period after booking confirmation. The cancellation conditions below apply.
8. Cancellation by the Tenant
All cancellations must be notified by email to:

- Cancellation more than 60 days before arrival: Full refund of sums paid, excluding any bank charges.
- Cancellation between 30 and 60 days before arrival: The deposit remains the property of the Landlord.
- Cancellation less than 30 days before arrival: all sums paid remain the property of the Landlord.
- No presentation: No refunds.
The Tenant is advised to take out cancellation insurance.
9. Cancellation by the Landlord
In the event of cancellation by the Landlord before arrival, the Tenant will be reimbursed in full for all sums paid. No additional compensation will be due, except in cases of proven fault on the part of the Landlord or where otherwise required by mandatory legal provisions.
10. Arrival and departure
- Arrival : from 4:00 PM
- Departure : before 11:00
Any other schedule must be subject to a prior written agreement with the Landlord.
11. Occupancy of the dwelling
The accommodation is designed for a maximum of 4 people. The Tenant agrees not to exceed this capacity without the prior written consent of the Landlord.
Subletting, transferring reservations, and organizing events, parties or gatherings are prohibited without prior written agreement.
The accommodation is non-smoking inside. Pets are only allowed with prior written consent from the Landlord.
12. Tenant’s Obligations
- Use the accommodation peacefully and in accordance with its intended purpose as a holiday rental.
- Respect the neighbors and the rules of the residence.
- Maintain the accommodation in good condition.
- Report any damage, malfunction or incident immediately.
- Return the accommodation in a satisfactory condition: clean dishes, rubbish removed, equipment used normally.
13. Landlord’s Obligations
The Landlord undertakes to provide accommodation that conforms to the description published on the website, is clean, equipped and in normal working order.
14. Condition report and inventory
A property inspection and/or inventory may be carried out upon arrival and departure. Unless written reservations are made within 24 hours of arrival, the accommodation is deemed to be in conformity and in good apparent condition.
15. Household
The flat-rate cleaning fee is set at 90 € Unless otherwise specified at the time of booking, these fees do not exempt the Tenant from returning the accommodation in a reasonable condition.
16. Sheets and Towels
The concierge service takes care of providing and cleaning bed linens and towels. This service is automatically charged at the time of booking, €24 per person. Upon request, this option can be removed and refunded.
17. Liability and insurance
The tenant is responsible for any damage caused to the property, its equipment, common areas, or to third parties during their stay. It is recommended that you check your home or liability insurance to ensure it covers seasonal rentals.
The Landlord cannot be held responsible for any loss, theft or damage affecting the Tenant’s personal belongings, except in cases of proven fault.
18. Swimming pool, residence and common facilities
When the accommodation provides access to shared facilities within the residence, their use must comply with the applicable regulations. Access periods, times, and conditions may vary depending on the condominium or residence.
19. Force majeure
Neither party shall be held liable for any failure caused by a force majeure event as defined in Article 1218 of the Civil Code.
20. Complaints
Any complaints regarding the stay should be sent by email to contact@cap-neree.fr. The tenant is encouraged to report any problems during their stay in order to allow for a prompt response.
21. Médiation
If the landlord is legally considered a professional under the Consumer Code, the tenant (consumer) may use a consumer mediator free of charge after attempting to resolve the matter amicably in writing. If the landlord is not a professional, disputes are governed by the rules applicable to relations between private individuals.
22. Applicable Law and Jurisdiction
These terms and conditions are governed by French law. In the event of a dispute, the parties will first seek an amicable solution. Failing that, the dispute will be brought before the competent French court.
